Code Compliance Process
The City of Derby Code Enforcement Officers take a proactive approach to code enforcement and actively look for code violations. When a code violation is found or a complaint is received and a violation is found, the owner and/or the occupant of the property where the violation exists will receive a notice of violation in the mail. The notice will identify the location of the violation, the violation that exists, and a timeframe for the violation to be corrected.
Residents who find it difficult to bring their property into compliance by the deadline can call Code Enforcement at 788-0301 to ask for an extension to bring their property into compliance. The Neighborhood Maintenance Grant Program may be able to help. You may also contact local church groups or civic organizations for assistance.
Violations that have received First and Final Notices and have not been brought into compliance may be enforced in the following ways:
Abatement: If bulky waste or tall grass and weed violations are not brought into compliance after the notification process the property will be abated by the city contractor and the owner will receive a bill for the abatement cost plus an administrative fee. If the bill is not paid by the due date, the bill will be added as a special assessment to the property.
Notice to Appear in Court: All violations, including habitual or repeat offenders, could result in a Notice to Appear in Derby Municipal Court if the violation is not brought into compliance by the due date. Violation of Derby Municipal Code is a class C misdemeanor and punishable by a fine of not more than $500 dollars or imprisonment not exceeding 30 days, or by both fine or imprisonment.
